Types of Work Visas and How to Apply For Them

A work visa is required if you are applying for a seasonal or temporary job, and you are not qualified for the position. To qualify for a work visa, your employer must obtain Department of Labor certification that demonstrates there are no qualified U.S. workers for the job you are applying for. R-1 Visa

An R-1 visa for work is a special kind of visa for religious workers in the US. To qualify for this visa, you must have previously worked for a nonprofit religious organization in the United States. You must have spent at least twenty hours a week in your job. The job you choose must be related to religion, which means that you must be a religious minister. A minister cannot work in a secular field. However, most clergy are qualified for an R-1 visa.

O1 Visa

If you're planning on working in the U.S., you may be wondering if you can apply for an O1 Visa. This visa is issued to non-US citizens who wish to work in specialty occupations. These workers may be eligible for an O-1 Visa because they can work in the United States without being required to obtain a Green Card. The O-1 visa has a processing time of approximately two to three months.

H-1B Visa

An H-1B Visa for work allows an employer in the United States to hire foreign professionals in specialized occupations. These jobs require high levels of specialized knowledge and skills. These visas are governed by the Immigration and Nationality Act, which protects U.S. workers and nonimmigrant temporary workers alike. Those hiring foreign workers must show that they pay their employees at least as much as U.S. workers in the same positions and with the same experience.

L-1 Visa

For L-1 visa, an applicant must be employed in a managerial, executive, or specialized knowledge position. A job's title and description should match the definition of that function. The USCIS will analyze these factors before approving an application. For example, if the job's title is "project manager" and the applicant is employed as a project manager, the job is unlikely to qualify as a managerial position.

Seasonal agricultural worker visa

The government is set to introduce a new visa for agricultural workers in the next few weeks. The government has given itself a few weeks to consult with industry and the private sector, but it has so far failed to mention the role of employers. Consultations are likely to involve the National Farmers Federation (NFF) based in Canberra and the Agricultural and Veterinary Council of Australia, located in Sydney. The new seasonal agricultural worker visa will be similar to the PLS, but without the requirement to work in agriculture.
